Jury Clears Mark Cuban of Insider Trading

Maury Phillips/Getty Images for DIRECTV

In a victory that could be as satisfactory as his Dallas Mavericks winning the NBA championship, Mark Cuban has beaten the Securities and Exchange Commission in a long-running contentious legal dispute.

The billionaire owner of Landmark Theatres, Magnolia Pictures and AXS TV, who also stars on ABC's popular Shark Tank, was charged with violating federal securities laws by trading on alleged inside information in the sale of Mamma.com. The SEC accused him of learning through the company's chief executive of a plan that would hurt the company's stock price. Cuban quickly sold his shares, avoiding $750,000 in losses, but he maintained that he didn't know that the information that was provided to him was confidential.

STORY: Mark Cuban Says Live TV Remains the Most Important Platform

On the witness stand, Cuban testified that he didn't remember details of a conversation nearly a decade ago. Attorneys representing the SEC struggled to demonstrate his mindset at the time of the stock sale. The agency pursued the case for many years -- having the case dismissed by a judge before revived by an appellate court. Through that time, the SEC mocked Cuban's "Hollywood production schedule.” There were also Cuban attacks on the wisdom of the SEC's expenditure of time and resources to hunt him.

Cuban was facing $2 million in penalties if found liable.

Instead, after three and a half hours of deliberation, a jury found in his favor. The defendant reportedly smiled as the verdict was announced.

Burton and Taylor

Burton and Taylor, the second TV movie this year about the tempestuous relationship between Elizabeth Taylor and Richard Burton, airs on BBC America Wednesday night. The previous dramatization, Lifetime’s Liz & Dick, starred Lindsay Lohan as Taylor and risibly chronicled the pair’s entire relationship, beginning with their toga meet-cute on the set of Cleopatra. The melancholic Burton and Taylor stars Helena Bonham Carter and Dominic West, and it focuses specifically on a few weeks in 1983 when the two, divorced and in their 50s, reunited professionally to star in Noel Coward’s Private Lives on Broadway. Sometimes the near simultaneous release of two movies of a similar subject undermines them both—think Armageddon and Deep Impact, or the dueling Prefontaine films—but any comparison between Liz & Dick and Burton and Taylor immediately glorifies Burton and Taylor, a relatively restrained, non-campy duet that does not feature Lindsay Lohan in a fright wig, just Bonham Carter nailing Taylor’s helium-inflected but bawdily down-to-earth cadences. (In this movie, as with most of Bonham Carter’s work, I am reminded that her initials alone make her a HBIC.

Eschewing the height of Le Scandale, Burton and Taylor focuses on a quieter, less-sexy, less-triumphant moment in the pair’s love story. They are middle-aged, dancing to disco, not sleeping together, in relationships with other people, ensconced in various addictions, and, as celebrities, well into the trashy phase of their fame, a state of being the staging of Private Lives did nothing to remediate. (Here’s a New York magazine story about Taylor at the time that highlights just how gossipy the production was.) Private Lives is a comedy about a divorced couple, newly married to other people, who passionately, dysfunctionally fall back into bed together, a tale that, obviously, tracked closely with the real story of Burton and Taylor. (In the play, as in life, the woman Burton left for Taylor was named Sybil.)

In Burton and Taylor, Burton is frustrated by the parallels: He insists that Taylor not play to the crowd, not winkingly acknowledge that the audience is there to see Richard Burton and Elizabeth Taylor, not their characters, in bed. But Taylor takes the opposite view, arguing that if that’s what the audience wants to see, then that’s what the audience should get. Simply by existing, Burton and Taylor takes Taylor’s side of the argument: What, after all, is the appeal of a movie like Burton and Taylor except as front row seat to Liz and Dick’s private lives?

If, however, you are not already interested in Burton and Taylor’s private lives, Burton and Taylor may feel extremely wan and floppy: a series of scenes in which two people behave badly toward  each other while stutter-stepping toward nothing more than an emotionally honest conversation. The performances, Bonham Carter’s in particular, are very fine, but the dramatic stakes are very low. As with last year’s My Week with Marilyn, Burton and Taylor avoids retreading familiar material by picking a relatively quiet, unexplored interlude in a celebrity’s life—the stuff of tasteful restraint, but not exactly scintillating story. And it only scans as tasteful restraint if the audience can fill in all the salacious history for themselves.

For those who can, Burton and Taylor is much more effective. The movie accentuates the increasingly salient feature of their famous romance, which was not its glamour, but its tragedy. Their love affair, passionate as it was, established them forever in our collective memory as lovers, not thespians. Burton, one of the greatest stage actors of his generation, threw his talent into largely mediocre movies and Elizabeth. Taylor, capable of extraordinary work, by the last decades of her life was better known for her multiple marriages than her films. The two are the poster couple for the way fame warps one’s life and work. Burton and Taylor is the poster.

Decision day in NJ's accelerated US Senate race

TRENTON, N.J. (AP) — New Jersey's abbreviated U.S. Senate race went to the voters Wednesday with candidates characterizing the contest as a referendum on the partisan gridlock that has paralyzed Washington in recent weeks.

Democrat Cory Booker and Republican Steve Lonegan each cast a ballot early in the morning in the special election to fill the seat of the late Sen. Frank Lautenberg, who died in June.

The election is the first since the partial federal government shutdown began more than two weeks ago. It came the same day Senate leaders announced a deal had been struck to reopen the government and avert a Treasury default.

"This is the only election in America right now where we will get a chance to make a statement about what is going on in Washington," Booker said after voting in downtown Newark. "This is a chance for us to send a message about the shutdown, about the gridlock, about all those forces that my opponent represents — the tea party — that says we shouldn't compromise, we shouldn't work together."

Booker, the high-profile mayor of New Jersey's largest city, had circulated a petition to end the shutdown and accused Congress of failing voters by not finding a way to work together.

Lonegan supported the shutdown, arguing the Affordable Care Act should be delayed a year and objecting to the concept of government-directed health insurance. In recent days, he has accused Booker of not even living in Newark.

After voting in Bogota, the city he led as mayor for three terms, Lonegan said he has been able to unite Republicans of all stripes.

"We've unified and I'm proud of that," he said. "The entire Republican party, from the tea party to the moderate wing to pro-life and not so pro-life. Everybody who cares about individual liberty."

In the shore town of Point Pleasant, nurse Mary Martin said she voted for Lonegan, a decision that wasn't influenced by the government shutdown.

"I'm a longtime Republican and I just think with the way we're headed, we need more conservative people in there," she said.

The two-month campaign played out under a compressed schedule and was the subject of controversy even before the two candidates were chosen.

Republican Gov. Chris Christie appointed a GOP caretaker and ordered the election held Oct. 16, the soonest date the law allowed following an unprecedented August primary.

Critics accused the governor of keeping the race off the Nov. 5 ballot, when he is up for re-election, to make it easier for him to win big as a Republican in a Democratic-leaning state and aid his potential national ambitions. During his first debate, he refused to rule out a run for president in 2016.

Public opinion polls showed Booker, 44, the second-term mayor of Newark, with a double-digit-percentage advantage heading into the election, where he hoped to secure a seat as the second African-American in the Senate along with Republican Tim Scott of South Carolina.

Booker on Wednesday called the opportunity to serve as senator "one of the greatest privileges any Jersey boy could have."

Marcy Phillips, a 30-year resident of Newark, covered her car in Booker signs and was driving around the city Wednesday urging people to vote.

"He's the best out of the candidates right now, and he's the one we need," she said. "As the mayor of Newark, he did his best and right now the whole city has changed."

Lonegan, 57, the former state director of Americans for Prosperity, a group advocating limited government that was founded by the billionaire Koch brothers, ran an aggressive, in-your-face campaign.

"We want a leader, not a tweeter," he said at one point, referring to Booker's prolific use of Twitter, where he has 1.4 million followers.

Both candidates drew on some big names for support — Oprah Winfrey helped raise funds for Booker, while the nation's largest tea party political action committee brought former Alaska Gov. Sarah Palin in to campaign for the GOP nominee.

The campaign took odd twists and turns for both candidates.

Booker was forced off-message to explain G-rated correspondence with a stripper he met while filming a social media documentary. Lonegan was forced to dump a longtime strategist after a lengthy, profanity-laced interview with a political website in which he claimed Booker's banter with the stripper "was like what a gay guy would say."

While in Newark, Booker has worked with Christie on common education goals, such as ending lifetime teacher tenure and increasing the number of charter schools. Newark schools remain under state control.

Lonegan repeatedly knocked Booker for the city's high crime rate and unemployment. At one point in the campaign, Booker announced a new crime-fighting strategy to cope with a string of 10 homicides in 10 days.

Lonegan said that as a mayor, he also has reached across the aisle in working with a Democratic borough council.

But Booker painted him as a tea party extremist, one who would — if sent to Washington — make the capital's gridlock worse.

FlyKly's Smart Wheel snaps onto your bike for 20MPH pedal assist

FlyKly

In retrospect, lower Manhattan probably wasn't the safest place to try the Smart Wheel for the first time. Thankfully, the prototype wasn't operating at top speed when I hopped on, for that very reason. The sensation's a bit weird for those unaccustomed to riding with a pedal assist, kicking in only when you actually start pedaling and gradually reaching the speed you've entered in the app. In its final version, that speed will max out at 20 miles an hour, for up to a 30-mile range. The motor weighs about nine pounds, snapping onto the rear wheel of most bikes without much in the way of installation. Also of note is the ability to remotely lock the wheel using the app to prevent someone from riding off with the bike -- and if they do, you can track the thief on your phone.

All of this is still early stages. The motor you see above is still a prototype. The final version will be offered in a number of different sizes and colors, assuming the company is able to hit its $100,000 Kickstarter goal. A $550 pledge will get you the Smart Wheel, along with FlyKly's Smart Light (which you can get as a standalone for $49). The light holds and charges your phone (via USB), while leading the way in the dark with an LED bulb. The company will also be opening up the app's SDK for use with additional hardware like the Pebble smartwatch. Check out a quick video of the above after the break.

Tina Fey, Amy Poehler back as Golden Globes hosts

NEW YORK (AP) — The duo of Tina Fey and Amy Poehler proved such a success at hosting the Golden Globes in January that they've been signed up for the same job for the next two years.

NBC, the Hollywood Foreign Press Association and producers of the Golden Globes announced the unusual two-year commitment on Tuesday. Next year's Golden Globes will be held in Beverly Hills, Calif., on Jan. 12.

Allen Shapiro, CEO of Dick Clark Productions, said the former "Saturday Night Live" chums have "a truly unique chemistry making them one of the most talented and captivating pairings of all time."

They were bathed in critical love for their performance this year, with Associated Press critic Frazier Moore calling them "the night's biggest winners." They got laughs without being polarizing, as was the case with predecessor Ricky Gervais. Poehler even poked fun during the show at the Hollywood debate over whether Gervais was too hard-edged in mocking Hollywood stars.

"We want to assure you that we have no intention of being edgy or offensive tonight," said Poehler, star of the NBC sitcom "Parks and Recreation." "Because, as Ricky learned the hard way, when you run afoul of the Hollywood Foreign Press, they make you host this show two more times!"

Fey, whose NBC comedy "30 Rock" ended this year, and Poehler were both nominated for best actress in a comedy or musical but lost to Lena Dunham, star of HBO's "Girls."

"Last year was really fun," Poehler said in an interview with the Hollywood Foreign Press Association. "We didn't know what to expect. It was exciting to work with Tina, as always, and it was a strange experience. We had a lot of fun so we said maybe we can try it again and like fools we are giving it another shot."

More important than critical support, Fey and Poehler were good for business. The Golden Globes had their best ratings in six years for the most recent presentation, and were up 17 percent over the 2012 show.

Even Before The Shutdown, Food Supply Regulated Itself

There have been a lot of headlines during the government shutdown suggesting that that our food supplies may be at risk as agencies like the Food and Drug Administration and the Centers for Disease Control have furloughed workers. But food suppliers and processors increasingly rely on a large network of private companies to make sure food is safe.

New Tunes Tues: 5 Songs To Know This Week From TLC, The Wanted and More

By Haley Longman

Into all boy bands, past and present, and will watch anything on TV about teens or pregnancy (so clearly Teen Mom is her favorite).

Welcome to New Tunes Tues, where I tell you what newly released songs/albums/music videos etc require your attention immediately. The just-announced news that Britney Spears titled her upcoming album Britney Jean is great, sure. But until we hear that album when it comes out in December, let’s take a listen to these five catchy beats, shall we?

Justin Bieber, “All That Matters.” Remember when Justin Bieber got carried up the Great Wall of China? Turns out it wasn’t merely a publicity stunt but it was for the music. His new video for “All That Matters” is Biebs hanging out atop the famous landmark. This is also a leaked version of the video so who knows if it’s the final cut, but it’s entertaining to watch nonetheless.

Red Foo, “Let’s Get Ridiculous.” LMFAO is still making music together, but 1/2 of the duo, Red Foo, just came out with his first solo single…which sounds exactly like an LMFAO single. Basically, it’s the perfect party song that you can envision the cast of  Jersey Shore fist-pumping to. Listen here:

TLC, “Meant to Be.” TLC’s biopic premieres next week on VH1, and their greatest hits album, 20, drops today. This song, “Meant To Be,” was written for the movie specifically, but it also appears on the album and is the band’s first single in six years. Lovin’ it.

OK! Exclusive: Brandon Boyd Spills On His Incubus Spin-off Band

Eminem, “Rap God.” It seems like Em is releasing one new song a week leading up to the November 5 release of The Marshall Mathers LP Part 2, doesn’t it? This is one of my favorites so far though because it’s the fast-talking Eminem lyrics fans are used to. And it reminds me of “Crazy In Love,” which is like my favorite Eminem song of all time.

The Wanted, “Show Me Love (America).” Ariana Grande‘s boy toy and his British bandmates also have an album coming out in early November, and this song is on it. This video just came out, like, yesterday, and The Wanted fans are freakin’ out over it already. Probably because black and white makes everything so much more sexy.

Delaying Measles Vaccine May Increase Risk of Seizures

Children who receive their measles vaccination on time have a lower risk of adverse events following vaccination than those who receive the vaccine later than is recommended, a new study finds.

In the study, children who received their first dose of a measles-containing vaccine at ages 12 months to 15 months — which is recommended by the Centers for Disease Control and Prevention — had a lower risk of experiencing fever or seizures shortly after vaccination than those who received the vaccine at ages 16 months to 23 months.

Previous studies have found that measles-containing vaccines are linked with a small increased risk of seizures brought on by fever, called febrile seizures, one to two weeks after vaccination. The reason for the link is not known, but scientists suspect an increase in virus replication occurring in this one- to two-week time period may cause fever in some children. Previously, it was not known whether a child's age affected their risk of fever or seizures following measles vaccination.  [5 Dangerous Vaccination Myths]

The findings "highlight the importance of timely immunization of children," the researchers, from Kaiser Permanente Vaccine Study Center in Oakland, Calif., wrote in the Oct. 14 issue of the journal JAMA Pediatrics.

Some parents delay vaccination based on the unproven idea that "too many vaccines" at once could overwhelm the child's immune system, said Dr. Paul Offit, chief of the division of infectious diseases at Children's Hospital of Philadelphia.

But that theory is unfounded, Offit said, as children's immune systems handle a wealth of challenges (such as bacteria and viruses in the environment) from the minute they are born. Children who do not receive vaccinations on time are at increased risk for catching vaccine-preventable diseases in the period when they are unvaccinated, Offit said.

The new study "just provides another reason why delaying vaccines would be an unreasonable thing to do, and potentially a more harmful thing to do," Offit told LiveScience.

"If vaccine safety is a concern, the currently recommended schedule is the best choice for preventing disease and minimizing adverse events," Offit and his colleague Dr. Kristen Feemster, of the University of Pennsylvania School of Medicine, wrote in an editorial accompanying the study.

The new study analyzed information from 840,348 children ages 12 months to 23 months who had received a measles-containing vaccine (measles, mumps and rubella; or measles, mumps, rubella and varicella (chicken pox)).

Children ages 16 months to 23 months were 6.5 times more likely to experience a seizure in the seven to 10 days following vaccination than on other days. For every 10,000 children vaccinated, this risk translates to about 9.5 extra seizure cases during the weeks following vaccination than would be expected without vaccination.

In contrast, for children ages 12 months to 15 months, the risk was lower. They were about 3.4 times more likely to experience a seizure in the seven to 10 days following vaccination than on other days. For every 10,000 children vaccinated, this risk translates to about four extra seizure cases during the weeks following vaccination.

The researchers emphasize that a child's risk of experiencing a febrile seizure that requires medical attention in the weeks following vaccination is very small — less than one in 1,000. What's more, the rate of febrile seizure following vaccination is seven times lower than the rate following natural infection with measles, the researchers said.

The researchers aren't sure why the risk of febrile seizures following vaccination is higher for older children. Perhaps children ages 16 months to 23 months have a more robust immune response to the vaccine, resulting in an increased risk of seizures, the researchers said. Also, children who receive vaccines late may be more likely to have underlying medical conditions, such as a higher risk of seizures, that prompt parents to delay vaccination in the first place, the researchers said.

Most febrile seizures are benign and do not pose health risks over the long term, Offit said.

Another study published last month found that young children who miss some of their whooping-cough shots, or receive the shots late, are at an increased risk of catching the disease.

Pressure on US at global economy meetings

WASHINGTON (AP) — World finance officials are keeping pressure on the United States to resolve a troubling budget stalemate.

The impasse in Washington is threatening a market-rattling default on U.S. debt that would seriously threaten the global economy.

The World Bank and the International Monetary Fund are wrapping up three days of talks.

The IMF's policy-setting committee says the U.S. needs to take "urgent action" to address the stalemate.

America's borrowing authority is set to lapse on Thursday.

Financial officials are hopeful the crisis will settled in time.

Mario Draghi, the head of the European Central Bank, says he thinks it's "unthinkable that an agreement won't be found."

Pluto's craters could get Star Trek names

Even though 'Vulcan' has been rejected as the name of one of Pluto's recently discovered moons, an astronomer has left open the possibility of naming some of Pluto's geographical features after Star Trek characters.

By Eoin O'Carroll,?Staff / July 3, 2013

After?delivering the devastating news to the 170,000 or so people who voted for "Vulcan" as a name for one of Pluto's recently discovered moons, SETI Institute planetary astronomer Mark Showalter offered Star Trek fans a possible consolation prize.

"We might have craters called Sulu and Spock and Kirk and McCoy and so on," said Dr. Showalter, in a Google Hangout video.

Showalter had just announced that the new official names for Pluto's moons, as selected by the International Astronomical Union, would be Kerberos and Styx, names that received fewer than 100,000 votes each in a public poll.

Even though "Vulcan" had the most votes, the IAU rejected it for two reasons. First, it had been the name of a planet that was thought in the 19th century to exist between Mercury and the sun, as a way of explaining peculiarities in Mercury's orbit. Einstein's Theory of General Relativity did away with the need for this extra planet, but these days, the term "Vulcanoid" describes an asteroid ? also hypothetical ? that orbits close to the sun.?

Second, the IAU said that "Vulcan" didn't fit in with the mythological underworld theme that guided the naming of Pluto's four other moons. Kerberos is the name of the three-headed canine that guards the gates to Hades, and Styx is the name of the river that separates the worlds of the living and the dead, as well as the name of the goddess who guards that river.

Pluto's other moons are named Charon, Nix, and Hydra. Charon is the ferryman who transports the souls of the dead across the Styx; Nix is the goddess of the night who lives in a deep abyss in the underworld, and Hydra is a many-headed serpent who guards a lake that is an entrance to Hades.

So no Vulcan. The name is at once too familiar and insufficiently hellish. But, as the SETI institute's Showalter noted,?its still possible that Star Trek fans might get a few craters named for their spacefaring heroes.

And yet, those craters are currently just as hypothetical as Vulcan and the Vulcanoids. There's no reason to believe that Pluto doesn't have them; indeed, it would be surprising if the dwarf planet turned out to be as smooth as a cue ball. But nobody has ever actually seen a Plutonian pockmark.

Ford's New Prototyping Machine Turns Sheet Metal Into Custom Parts

A modern assembly line can churn out a new vehicle every few minutes, but when carmakers want to build and test a prototype, it takes weeks to produce the dies and moulds needed to stamp out a custom one-off part. So Ford has developed a fantastic new prototyping machine that functions kind of like a 3D printer in that it can produce a custom part in mere hours. Except that instead of plastic, it works its magic on sheet metal.

Richard (RJ) Eskow: A Popular Movement For Higher Taxes? Now There's a Story.

"The American people are on our side," says Rep. Keith Ellison, co-chair of the Congressional Progressive Caucus.? "The time is now."

Ellison was talking to a small group of writers and activists about higher tax rates for US corporations.? Although he was upbeat, Ellison acknowledged that winning those tax increases would be an uphill fight.

That kind of effort can't succeed without widespread public action behind it. Can an organized movement be created to support tax increases for corporations?

Stories

When organizer and Harvard professor Marshall Ganz says that social change begins with the telling of stories, he's not necessarily talking about the stories in this graph. Although taxation can seem like a dry subject, even a simple image like this one resonates with powerful and troubling tales:

2013-07-02-corptaxratesdown.JPG
(Via Americans for Tax Fairness/USPIRG)

This graph tells the story of a nation that is starving its government of funds for urgently-needed social services. In human terms, that's the story of a child struggling to learn in an oversized classroom with flaking paint. Or of an elderly man in a one-room apartment whose Meals On Wheels deliveries stopped arriving weeks ago.

It speaks of corporations reaping record profits while paying less in taxes than at any point in modern history. That's the story of lobbyists celebrating their latest big-business tax break over drinks at Tosca or the Old Ebbitt Grill in Washington DC.

It tells the stories of financial institutions like GE Capital, Goldman Sachs, Bank of America, and Wells Fargo enjoying huge tax breaks even after repeatedly breaking the law. That's the story of self-satisfied murmurs being exchanged in lower Manhattan boardrooms.

This image tells the story of Apple Inc., which earned its record profits through the taxpayer-funded education of its workforce, the taxpayer-funded inventions that drive its products, and the once-thriving middle class that has now been driven from the Silicon Valley.

That's the story of the machinist who adopted Steve Jobs, raising him in a comfortable and upwardly-mobile way of life that is disappearing from Jobs' home town.

This picture tells the story of individual Americans who must sacrifice so that these corporations can be indulged: Americans who pay more in taxes, receive less in government services, and watch as an economy which was once prosperous for the many increasingly serves only the few.

And it tells the story of the small and medium-sized businesses which have been left out of this tax bonanza, the real engines of jobs and growth which have been excluded from this holiday for the massive and the powerful.

As Keith Ellison says, "Your local coffee shop didn't get any fat tax breaks."

A different story.

It defies today's media narrative to imagine a popular movement calling for for tax increases.? Our major press outlets prefer to attach the 'populist' label to anti-tax movements, especially the Tea Party. ?But the Tea Party's anti-tax views are on the fringe of American opinion, while Ellison's are very much in the mainstream.

A new study from pollster Celinda Lake illustrates the depth of American public opinion on this issue. ??More than half of voters in a recent survey said that it was "very important" that the next budget "ensure that corporations pay (their) fair share of taxes." More than half also considered it "very important" to "close tax loopholes that benefit big corporations."

Lake, who attended the gathering with Rep. Ellison, pointed to poll results showing that more than two-thirds of those polled were persuaded by messages like this one:

"We should end tax breaks for corporations that ship jobs overseas and use that money to invest in jobs in America - improving our roads and bridges, rebuilding manufacturing, and making us energy independent."

Lake noted that certain messages resonated especially strongly with voters, including "Buy American, Hire American" and the description of offshoring corporations as "Benedict Arnolds."

The public's will harmonizes with that of economists who agree that more government revenue which can be invested in jobs, infrastructure, education, and anti-poverty programs would quickly translate into a healthier economy.

Man bites dog.

For his part, Ganz was speaking of?inspiring stories. He encourages the telling of individual and collective narratives that lead to successful change. Where will we find stories like that in this struggle?

People are discouraged. They increasingly feel that corporations always win. So we could begin by talking about ourselves: the world we knew as children, the world we hope to see for our own children.

We could speak of past victories against even longer odds:Breaking up the railroads and the trusts. The successful battles for workplace safety and the minimum wage.

And we could remind ourselves of the larger fight for economic freedom, which created the middle class and led to our longest period of national prosperity.

That fight was, and remains, the fight for the American ideal: a fair and just nation where anybody can succeed if they're willing to work hard and play by the rules.

Our media frequently reports on the Tea Party as if it were a genuine grassroots movement, rather than a corporate-funded effort to tap into the public's economic fears and political frustrations. Many of the public emotions driving the Tea Party could be constructively channeled into a movement for genuine economic justice.

A populist fight for higher taxes? To many reporters that would be what people in the trade once called a "man bites dog" story. And that's news.

The absence of a debate.

Unfortunately, the "left" side of the debate is currently represented by President Obama's unwise proposal to "simplify" the tax code by eliminating many deductions and lowering the basic tax rate in a way that's described as "revenue neutral." "Revenue neutral"? That would freeze corporate taxes at their current, destructively low levels.

And while the President is right to oppose many corporate tax breaks, the net effect of his current budget proposal -- his opening bid in negotiations with Congress -- would only raise corporate taxes by one percent.

What's more, the President's proposal to eliminate many deductions would rob lawmakers of the tools they need to discourage abusive behavior, like polluting the environment and shipping jobs overseas, or to reward socially constructive behavior like hiring more Americans or investing in equipment that produces more jobs. His?proposal to eliminate taxes on overseas profits would cut corporate rates even further.

Obama's position on corporate taxation has become the de facto position of his party, thereby robbing the public of a real debate. ?On this issues, as with so many others, the majority's will remains marginalized inside the Beltway.

It doesn't have to remain that way.

The coming struggle.

Change is possible. There's a strong alignment between the interests and desires of most voters and those of small and medium-sized businesses. People overwhelmingly support increasing tax contributions from large corporations.

Why is the Washington consensus so out of touch with the public's will or the needs of the economy? "You can have seventy or eighty percent of the people on your side," says Ellison, "and still find that a highly organized minority can beat a diffuse majority."

That's true - especially when the minority in question contributes hundreds of millions of dollars to political campaigns, and has a habit of offering highly lucrative Board memberships or lobbying jobs to politicians once they leave office.

But there are ways to counter that kind of influence. One of the best is by threatening politicians with the thing they fear most: losing elections.

Now.

And the time to act is now. "Inside Congress," says Keith Ellison, "taxation is already a full-on conversation."

"We're not talking in isolation when we talk about corporate taxes," Ellison adds. "We're literally telling people we cannot afford Head Start, student loans, or Social Security."

"We should look for opportunities to create and agitate the debate," Ellison says. "There are members of Congress, even Republicans, who might be persuaded to end corporate tax giveaways."

That's not likely to happen unless corporate lobbyists' concerted pressure is met with equally intense counter-pressure from an organized majority. ?Politicians are far more likely to change positions on an issue if they hear from their constituents in concerted and forceful ways, from frequent emails and telephone calls to public demonstrations. Democrats could be particularly responsive to the possibility of primary challenges against those who have become too corporation-submissive. But an effort like that will take hard work.

And work like that begins with stories.

Snowden applies for political asylum in Russia, rants against Obama administration

President Barack Obama comments on former NSA contractor Edward Snowden, who is reportedly still inside a Moscow airport without a valid passport. Obama made the remarks Monday in Tanzania.

By Tracy Connor, Staff Writer, NBC News

Professed NSA leaker Edward Snowden has applied for political asylum in Russia, but President Vladimir Putin says he can stay only if he stops "damaging our American partners." Only hours later, Snowden released a statement railing against the U.S. government.

Russia was one of about 20 countries that the anti-secrecy group WikiLeaks, which has been assisting Snowden in exile, said it had approached for asylum on Snowden's behalf.?Others included China, Cuba, France, Germany, Italy, India, Nicaragua and Spain.

Putin told reporters that Russia won't hand Snowden over to U.S. authorities, but he said there would be strings attached if he wants to remain in Moscow.

"If he likes to stay here, there is one condition: He should cease his work aimed at damaging our American partners. No matter how strange it will sound from me," Putin told reporters, adding that Snowden isn't working for Russian intelligence.

He said he doubted Snowden would curtail his activities and suggested that the former National Security Agency contractor should figure out which country he wants to wind up in and "move there."

Snowden left the U.S. for Hong Kong before he allegedly leaked top-secret details of U.S. surveillance programs and was charged with espionage. With the help of WikiLeaks, he traveled to Moscow eight days ago.

The U.S. does not have an extradition treaty with Russia, but President Barack Obama noted that Snowden traveled to Moscow without legal papers and referred to "high-level" discussions between the two countries about the case.

"We are hopeful that the Russian government makes decisions based on the normal? procedures regarding international travel and the normal interactions that law enforcement have," Obama said.

It was thought that Snowden would eventually head for Ecuador, but the president of the South American country said this week that no asylum request was sent and suggested Russia would make the call on when Snowden could leave and where he would go.

And in a statement released late Monday through WikiLeaks, Snowden claimed the White House is pressuring other countries to deny him asylum.

"The Obama administration has now adopted the strategy of using citizenship as a weapon," his statement said.

"This kind of deception from a world leader is not justice, and neither is the extralegal penalty of exile. These are the old, bad tools of political aggression. Their purpose is to frighten, not me, but those who would come after me," he added.

"Although I am convicted of nothing, it has unilaterally revoked my passport, leaving me a stateless person. Without any judicial order, the administration now seeks to stop me exercising a basic right. A right that belongs to everybody. The right to seek asylum."

While Snowden remains in legal limbo, new claims about U.S. surveillance based on his purported leaks continue to emerge.

Obama addressed reports that the NSA has bugged America's European allies with something of a shrug, saying it should not be a surprise that intelligence agencies seek "additional insight beyond what's available through open sources.?

"If that weren't the case, then there'd be no use for an intelligence service," Obama told reporters while traveling in Africa.

?And I guarantee you that in European capitals there are people who are interested in, if not what I had for breakfast, at least what my talking points might be should I end up meeting with their leaders,? he added.

?That's how intelligence services operate.?

He said his team would look into the allegations and report back to European Union allies, who have expressed concern and, in some cases, outrage.

Secretary of State John Kerry, who is traveling in Brunei, echoed Obama's statement.

"I will say that every country in the world that is engaged in international affairs of national security undertakes lots of activities to protect its national security, and all kinds of information contributes to that, and all I know is that that is not unusual for lots of nations," he said.

"But beyond that, I'm not going to comment any further until I have all of the facts and find out precisely what the situation is."

Wendy Davis Offers A Warning For Democrats - Bloomberg

Bloomberg:

The pro-choice side won the last battle in the abortion wars. It?s overconfident about the next one.
Governor Rick Perry has summoned the Texas Legislature for a second special session to pass legislation regulating abortion. The bill was set to pass at the end of the first special session, but a shouting mob disrupted the state Senate so it couldn?t act. That mob was inspired by a filibuster against the bill led by Senator Wendy Davis, who has now become a heroine to social liberals across the country and may run for governor herself.

LAX's New Terminal is the Biggest Public Works Project in City History

LAX's New Terminal is the Biggest Public Works Project in City History

For the first time in a quarter century, Los Angeles International Airport is getting a facelift. Crews have just completed the first phase of renovations to The Tom Bradley International Terminal at LAX and it looks simply stunning.

The Bradley Terminal hadn't been updated since 1988 and was definitely beginning to show its age. That is, until the design team at Fentress Architects got their hands on it. The firm, whose other notable works include the Denver, San Jose, and Seattle-Tacoma airports, drew inspiration from the Pacific Ocean and incorporated a wave motif into the architecture as evidenced by the broadly sloping roofline resembling a crashing wave. As the Fentress site explains:

The Los Angeles ambiance is captured with Pacific Ocean-inspired roof forms that recall rhythmic waves breaking on the shore. The wave-like ceiling will reduce solar glare and heat from the ocean on the west and bathes the terminal in natural light from the northeast. Expansive glass curtain walls offer dramatic views of the airfield and the nearby Santa Monica Mountains. The architecture unifies the airport and pays homage to the Theme Building's parabolic arches.

In addition, the 850,000 square-foot, three story terminal will offer the most advanced Integrated Environmental Media System, an interactive multimedia architecture designed to improve the traveling experience and ease congestion in the sixth busiest airport in North America, when it opens to the public at the start of next month. DAR ES SALAAM, Tanzania (AP) ? President Barack Obama is encouraging embattled Egyptian President Mohammed Morsi (MOR'-see) to respond to concerns being voiced by throngs of protesters seeking his removal from office.

The White House confirmed in a statement Tuesday that Obama called Morsi on Monday while traveling in Africa. The call came as Egypt's military said Morsi must meet the demands of millions of protesters who have taken to the streets.

The statement said Obama told Morsi that the United States is committed to the democratic process in Egypt and does not support any single party or group. The statement also said Obama underscored to Morsi that the current crisis can only be resolved through a political process.

Obama also told Morsi he's particularly concerned about violence in the demonstrations, especially sexual assaults against women.

Officials: Car bombs, shooting kill 30 across Iraq

(AP) ? A string of nearly a dozen apparently coordinated bombs and a shooting killed at least 30 and wounded scores across Iraq on Sunday, extending a wave of violence that is raising fears of a return to widespread killing a decade after the U.S.-led invasion.

Violence has spiked sharply in Iraq in recent months, with the death toll rising to levels not seen since 2008. Nearly 2,000 have been killed since the start of April.

Most of the car bombs hit Shiite-majority areas and were the cause of most of the casualties, killing 26. The blasts hit half a dozen cities and towns in the south and center of the country.

The blasts began when a parked car bomb went off early morning in the industrial area of the city of Kut, killing three people and wounding 14 others. That was followed by another car bomb outside the city targeted a gathering of construction workers that killed two and wounded 12, according to police.

Kut is located 160 kilometers (100 miles) southeast of Baghdad.

In the nearby oil-rich city of Basra, a car bomb exploded in a busy downtown street, police said. As police and rescuers rushed to the scene of the initial blast, the second car exploded. A total of six people were reported killed. Basra is located some 550 kilometers (340 miles) southeast of Baghdad.

About an hour later, two parked car bombs ripped through two neighborhoods in the southern city of Nasiriyah, 320 kilometers (200 miles) southeast of Baghdad, killing one and wounding 17, another police officer said.

And in the town of Mahmoudiya, 30 kilometers (20 miles) south of Baghdad, two civilians were killed and nine wounded when a car bomb went off in an open market.

In the Shiite holy city of Najaf, 160 kilometers (100 miles) south of Baghdad, a blast struck a produce market, killing eight and wounding 28.

And in Madain, a roadside bomb and then a car bomb exploded, killing three and wounding 14. Madain is about 20 kilometers (14 miles) southeast of Baghdad.

Near Hillah, a car bomb parked in a parking lot exploded, killing one and wounding nine. Hillah is about 95 kilometers (60 miles) south of Baghdad.

The shooting happened near the restive northern city of Mosul. Police officials say gunmen attacked police guarding a remote stretch of an oil pipeline, killing four and wounding five. Mosul, some 360 kilometers (225 miles) northwest of Baghdad, has been the scene of some of the deadliest unrest outside of the Baghdad area in recent weeks.

Medical officials confirmed the casualty figures. Officials spoke on condition of anonymity as they weren't allowed to release the information.

There was no claim of responsibility for any of the attacks, but they bore the hallmark of al-Qaida in Iraq, which uses car bombs, suicide bombers and coordinated attacks to target security forces, members of Iraq's Shiite majority, and others.

The attacks came a day after the leader of al-Qaida's Iraq arm, known as the Islamic State of Iraq, defiantly rejected an order from the terror network's central command to stop claiming control over the organization's Syria affiliate, according to a message purportedly from him. Abu Bakr al-Baghdadi's comments reveal his group's determination to link its own fight against the Shiite-led government in Baghdad with the cause of rebels trying to topple the Iran-backed Syrian regime.
